Las Vegas Area Renters - Be Careful - How to Find Out if the Home You Are Renting (or want to rent) is in Default

 

Unfortunately this was not originally placed under the Property Management group so I am re-blogging it as it really relates to our industry!!

I decided it was time to update and rewarn all Las Vegas Renters and POTENTIAL Renters of the signs that your home you are renting (or want to rent) is in stages of foreclosure.

I perform many BPOs.  BPOs are Broker Price Opinions which means banks are just searching for opinions on list pricing for a home.  The home may already be foreclosed upon OR it may be in various stages of default or foreclosure.  This allows me see trends before they start happening.  While I have seen this in the past before, I have seen it way too much in the last week:  homes listed for rent that are in default!  This means, that if a solution doesn't come about for the owner of the home, the renter may pay all deposits, move in and find themselves speechless and homeless when the home goes into foreclosure.

Here are ways to protect yourself:

Find out when the home was purchased or if it was refi'd (for cash out) during the boom years (2003-2007.)  This could help you gauge if the home is upside down and could go into default.  This isn't a sure-fire way to protect yourself from heartache soon after you move in as I have seen some neighborhoods and areas have sub-80's pricing.  You can see this information on the recorder's website which I am about to give you.

Get the deposits & rents escrowed.  Instruct escrow to pay the mortgage payments AND HOA dues rather than relying on the owners to do that.  Also instruct escrow that in the event of foreclosure, the deposits and rents are to be released to you, the renter.  This will help protect you from the nightmare of having to fight a broke landlord, (who may file for bankruptcy protection,) for your deposits.

This is a tutorial for renters who are curious about the foreclosure status of the property you are renting (or are about to rent).

With the wave of foreclosures in the Las Vegas Area, many renters are concerned if the property they are renting is in good standing or about ready to get foreclosed on.  Even if you have been paying your rent or even have a lease option on the property, it is not a bad idea to make it a habit to check on a monthly basis.

It is also a good idea to check prior to renting a home!

Step 1:  Go to the Clark County Assessor's office and click on search, under real property records click "address".  The reason why you may not want to search by name is that many investors hold title in an LLC.

Step 2:  Fill in street number and street name.  Make sure you check the box next to "show current parcel number record"

Step 3:  Many addresses show up so write down the parcel number next to the address:

Step 4:  Go to the Clark County Recorder Home page for "Land & RPTT Information".  Scroll to the Arrow and choose "Search Records" 

 Step 5:  Read Terms and Accept (if you accept terms:)

Step 6:  Click on Parcel # (for Search):

Step 7:  Look for the following: 

Lien:  Look for liens.  Could be from homeowner's association or from master plan.  These entities may foreclose on the house!

Breach or Notice of Default:  Owner is in Default of their loan.  Foreclosure may or may not be in the works.  General rule of thumb, if house is going to be foreclosed on, it will happen in the next 3-6 months from recorded date

Notice of Sale or Notice of Trustee Sale:  Foreclosure is imminent.  Usually 30-60 days from recorded date

Trustee Deed:  House is foreclosed on

If your rental home is in default, please consult a real estate attorney prior to breaking a lease or stopping your rental payments!

Area Tenants Want LONG TERM LEASES @ a DISCOUNT?! Good Luck!!!

Many new-hires coming into the area know their length of stay with their employer or school term and they want to sign long-term leases for 2 to 3 years and they are asking for a discounted rent.....they are SURPRISED when I say NO and NO!!!

Just like with a fixed term COMMERCIAL lease, there are escalating landlord costs with RESIDENTIAL properties also * taxes, insurance, HOA costs, repairs and maintenance.  To DISCOUNT the rent 2 or 3 years in ADVANCE of KNOWING these costs puts the property owner at an EXTREME disadvantage.  While the ATTRACTION of having a KNOWN resident (income stream) for several years is ENTICING for many property owners, by NOT building in rent escalators during the lease, they are GIVING AWAY the $$$ they think they have saved.

I will be increasing rents on most current residents with my lease renewal offers in late January and February, 2010.  The % will be between 3 to 5%.  For properties I am renting NOW in the slow season, I will end leases in the summer, 2010 OR I will increase rents after 6 months and end leases in 12 to 18 months - preferably 18 months - the summer of 2011.

I'm watching the Sprint Cup Championship banquet from the Wynn Hotel from Las Vegas where Jimmie Johnson (#48 Lowes Chevrolet) has won an UNPRECEDENTED (the CORRECT use of the term)  4th CONSECUTIVE championship * like Tiger winning the Masters 4X in a row * and Brooks & Dunn are on stage singing ONLY IN AMERICA when members of the armed forces marched on stage and salute WHILE tape of NASCAR races plays 10 feet tall behind them....

 

Jimmie's wife is MUCH MORE BEAUTIFUL!!!

Why there will never be a FairHousingGate!!!

The term "gate" is now commonly being used to expose government fraud - Watergate is the DC landmark made famous by the burglars who broke into the DNC hq in the mid-70s....WATERGATE became the scandal that brought down the Nixon White House.

Several "gates" have come forward from IranGate involving guns for hostages; CamillaGate involving telephone conversations between Camilla Parker-Bowles and Prince Charles: and NOW we have ClimateGate involving the bogus science surrounding the Global Warming/Climate Change hysteria.

....But, there won't be a FairHousingGate....there SHOULD be, but there won't.  

Complainants (prospects or tenants) don't want the fact that they filed a complaint to be known to future landlords * this is why the complaint itself is usually filed in the name of a state or fair housing agency * sometime the Department of Justice * so acknowledging the complainant is a no-no!!

Defendant (housing providers), while their names are known from the complaint, are barred from discussing or even acknowledging that they are a party to a complaint.

I have been a party to a fair housing complaint and have been fairly open about it * my name appeared on the state's real estate and fair housing websites for a few years.  Since the complaint was CLOSED * EVERYTHING about the case has been expunged * including from the state real estate website * like it NEVER happened.

Now * on the web * there are numerous listings of fair housing complaints * either in process or after they were closed because fair housing agencies are having their funding cut and they need to stay in business.....the easiest way to keep complaints coming in is to publicize them and these are being listed on the Fair Housing website http://www.fairhousing.com/   Most of the items listed are from newspapers AFTER complaints have been settled and where the fair housing agencies are tooting their own horn.

So.....unless a serious hacker can get into the HUD or DoJ websites to see how data and testimony are manipulated, how this extorting of the nation's housing providers is actually done and for what purpose will be kept secret.
