FORGET that he probably did not have them installed by licensed electricians, Jose Canseco is TWEETING he needs a pro bono attorney to get his FIXTURES back from the LA landlord who just evicted him.
The TIME for claiming and removal of Personal Property is BEFORE the sheriff comes to the property to remove the humans and secure any furniture for the landlord to deal with. AFTER that time, the landlord can certainly make the claim that the property was ABANDONED and depending on the manner that they are affixed to the property, they BECOME the property of the landlord as FIXTURES!!!

Good luck with that one Jose.
Folks who install personal property, in this case chandeliers, in rentals aren't very smart.
Jose has far more troubles in his life than missing a few "chandeleers." Did he use his rent money on steriods....sorry allegied steriods?
What kind of loser installs chandeliers in a rental property?.
Good morning Wallace,
I'm with Cindy Jose has far more troubles in life than his chandeleers he left behind! Lenn is also has a point about renting and adding personal property..not smart!!
Installing personal items in a rental is like they say in baseball, an error...
I've had renters install their own lite fixtures in high-end homes including chandeliers; however, I have always provided the name of an approved electrician and made sure they were removed when the residents vacated.
In CA, Jose had PLENTY of notice that the sheriff was coming to serve the writ of possession * loads of time to get the fixtures DOWN
Canseco does indeed have more serious problems than the loss of a few chandeliers. What's he going to do now, hang them in his car?
Landlord can sell them on ebay and make back whatever he's due from Cansenco. I can see the ebay listing now... "Own the chande"leers" that Cansenco once partied with!".
Many renters in Florida install ceiling fans in rentals which can be pricey - Jose should have removed them prior to his eviction - I am sure it didn't take him by surprise - I feel sorry for him - can't kick someone when their down - but baseball players sometimes think they are ABOVE the law and therefore want the public to side with them when they are obviously wrong -
I think I've got the fixture thing figured out. If a tennant attaches his wife to the ceiling, is she then the landlord's wife?
Mike * she is CHATTEL and not a FIXTURE and the landlord can not "convert" to his own use without going through some hoops....sorry, wrong metaphor....around some bases.
I need an attorney pro bono - what chutzpah this guys really has - lol
Wallace,
Good post. This is a great teaching text for many reasons. :)
Steve
Wallace,
There is some confusion caused by the fact that in most states "fixtures" are real estate except comarical fixtures remain personal property!
But I suspect this guy is just plain stupid!
Bill
I have about 100 of his rookie cards, what a waste of everything that is good
Wait... he's an athlete, the rules aren't supposed to apply to him (or to politicians... another post).
Wallace,
This post is now featured in "Celebrating Free Enterprise." Congratulations. :)
Steve
He will need more than luck on this one. He needs to stop worrying about the wrong things and move on with this life and get himself together.
How ridiculous he would be evicted and then ask for someone to represent him for free.
Since he no longer has a trade I guess there would be not trade fixtures involved.
Looks like Jose, like Jethro Bodine, did not get past the 6th grade. He might spell 'Tweet' as 'Twit' for all I know.
